1. Scope and Provider
These Terms of Service (“Terms”) govern your use of the “Snapcard Ninja” web application and iOS app (collectively “Service”).
Provider: SNAPCARD AI, Email: hi@snapcard.ninja.
2. Service Description
(1) The Service provides AI-powered study tools including flashcard creation from uploaded images (“Flashcards”), worksheet and task solving (“Solve”), an AI chat assistant (“Chat”), voice interaction (“Voice”), and additional features as offered from time to time.
(2) Usage system (controlling contract terms):
Pro plan: Monthly AI allowance as per the current plan; usage is displayed as a percentage of the available allowance.
Consumption: Based on actual AI tokens processed (input, output, and image tokens) per request.
Allotment/Reset: The allowance resets at the start of each billing month and expires at the end of the billing month. No cash-out or transfer.
(3) Free tier (if offered): As displayed on the product page. Free-tier allotments may vary.
(4) Marketing statements (“up to …”): Comparative phrases used in the app or on landing pages are illustrative only. The definitive entitlements are the allowance set out in these Terms and the usage shown in your account. In case of discrepancy, these Terms and your account balance prevail.
(5) Generated sets are stored in your account and can be renamed or deleted.
(6) Beta or preview features may be provided without stability or availability guarantees.
3. Accounts, One-Account Policy & Minors
(1) Registration is required via Google Sign-In or Apple Sign-In. Information provided must be accurate and kept up to date.
(2) One account per person: Each user may hold only one account. Creating or operating multiple accounts — for example to obtain additional free-tier allowances or to circumvent a suspension — is strictly prohibited. We reserve the right to terminate all accounts associated with a single person in case of a violation. This applies regardless of whether different email addresses, sign-in methods, or devices are used.
(3) No account sharing: Accounts are personal and non-transferable. Sharing login credentials with others is prohibited.
(4) Age requirements: The Service requires registration via Google Sign-In or Apple Sign-In. By registering, you represent that you meet the minimum age requirements of your chosen sign-in provider (see Google's Terms of Service and Apple Media Services Terms and Conditions). The Service is not directed to children under 13. Users aged 13–17 may use the Service only with parental or legal guardian consent as required by applicable law; we may request proof. We rely on the account-level age controls provided by Google and Apple and do not independently verify user age.
(5) You are responsible for safeguarding your credentials and for all activity that occurs under your account.
4. Prohibited Use & Moderation
(1) The following are prohibited: unlawful content (including intellectual property or privacy infringements), CSAM, hate speech/incitement, glorification of violence, fraud or deception, spam/abuse, automated mass uploads, circumventing security or usage limits, reverse engineering, and any action that disrupts or overloads the Service.
(2) Users are solely responsible for their uploaded content and its legality.
(3) Using VPNs, proxies, or similar tools to obscure your identity or to circumvent usage limits, geographic restrictions, or account restrictions is prohibited and may lead to immediate account suspension or termination.
(4) We may review, restrict, or remove content and suspend or terminate accounts upon reasonable suspicion of a violation. We will notify affected users to the extent required by law. A notice-and-action channel is available via email to report allegedly illegal content.
5. Content & Licenses
(1) You retain ownership of your content. You grant us a worldwide, non-exclusive, royalty-free license to host, process, store, display, and secure your content as necessary to operate and improve the Service.
(2) Uploaded content (images, documents): Files you upload are stored indefinitely to keep them available in your chat history and library. Deletion occurs upon your request or account deletion.
(3) AI output: AI-generated results may be inaccurate or incomplete. You remain solely responsible for verifying results before use, especially in educational, professional, or examination contexts.
(4) We do not train our own AI models on your content. Third-party AI providers process your content to deliver the Service; see the Privacy Policy for details.
6. Pricing, Payment, Term, Cancellation
(1) Pro (web/Stripe): €9.99 per month (tax-inclusive where applicable), processed by Stripe.
(2) Pro (iOS App): Pricing and billing are managed through the Apple App Store in accordance with Apple's terms. The price displayed at the time of purchase applies.
(3) Term/Renewal: Monthly; auto-renews until cancelled.
(4) Cancellation (web): Any time via the in-account “Cancel now” button, effective at the end of the current billing month. Unused allowance expires at period end.
(5) Cancellation (iOS): Managed through your Apple ID subscription settings in the App Store. Cancellation takes effect at the end of the current billing period.
(6) Payment issues: Pro features may be suspended upon failed or reversed payments.
7. EU Right of Withdrawal (Consumers)
(1) EU consumers have a statutory 14-day right of withdrawal from the date of contract conclusion.
(2) By subscribing to Pro and requesting immediate access, you expressly acknowledge that performance has begun and that the right of withdrawal is thereby extinguished upon activation of the subscription.
8. Availability; Maintenance
Best-effort availability; 100% uptime is not guaranteed. Maintenance windows and unplanned outages may occur without prior notice.
9. Fair Use and Rate Limits
To protect the Service for all users, fair-use, rate, or security limits may apply (e.g., per minute/day/month). These limits are designed to ensure stability and prevent abuse and will not be applied in a manner that unfairly disadvantages legitimate users.
10. Liability
(1) Unlimited liability applies for intentional conduct, gross negligence, and for damages arising from injury to life, body, or health, under applicable product liability law, and for any express guarantees given.
(2) For simple negligence, liability is limited to breaches of material contractual obligations, and then only to the typical, foreseeable damage.
(3) No liability for third-party content or AI errors beyond statutory obligations.
11. Violations; Suspension/Termination
We may suspend or terminate accounts for material or repeated breaches (including abuse, bot traffic, limit circumvention, or operating multiple accounts). Where reasonable, we will warn before suspension. Prepaid fees are not refunded unless the suspension was unjustified.
12. Privacy
See our Privacy Policy for information on how we collect, use, and retain personal data, including data retained for abuse and fraud prevention.
13. Changes to the Terms
We may modify these Terms for valid reasons (changes in law, technology, or features) with reasonable prior notice. You will have the right to object or cancel. Changes to Free-tier allotments are reserved; the Pro entitlement will not be reduced during a billing period already paid.
14. Governing Law; Severability
(1) German law applies; mandatory consumer protection provisions of your country of habitual residence remain unaffected.
(2) The EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr. We are not obliged to participate in any alternative dispute resolution procedure.
(3) If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force.
